The controller is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union law or by the law of the Member States, provision may be made for the controller or for the specific criteria for his designation in accordance with Union law or the law of the Member States.

Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Recipient means any natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not that person is a third party. However, authorities which may receive personal data in the context of a specific investigation mandate under Union or national law shall not be considered as recipients.

Third party shall mean any natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data.

Consent shall mean any freely given specific and informed unequivocal expression of the will of the data subject in the form of a declaration or other unequivocal affirmative act by which the data subject signifies his or her consent to the processing of personal data relating to him or her.

2 Collection, processing and use of personal data

2.1 Legal basis of the processing

Art. 6 I lit. a DS-GVO serves our company as a legal basis for processing operations for which we obtain consent for a specific processing purpose.

If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the supply of goods or provision of other services or consideration, the processing is based on Art. 6 I lit. b DS-GVO. The same applies to such processing operations which are necessary to carry out pre-contractual measures, for example in cases of enquiries about our products or services.

If our company is subject to a legal obligation which makes it necessary to process personal data, for example to fulfil tax obligations, processing is based on Art. 6 I lit. c DS-GVO.

Finally, processing operations could be based on Art. 6 I lit. f DS-GVO. Processing operations which are not covered by any of the above legal bases are based on this legal basis if processing is necessary to safeguard a legitimate interest of our company or of a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 sentence 2 DS-GVO).

If the processing of personal data is based on Article 6 I lit. f of the DS-GVO, our legitimate interest is to carry out our business activities for the benefit of the well-being of all our employees and our shareholders.

2.2 Personal Data

Personal data is information about factual or personal circumstances of an identified or identifiable natural person. This includes, for example, your name, your customer number, your telephone number, your address, as well as all inventory data that you provide to us during registration and when creating your customer account.
Statistical data, which we collect, for example, when you visit our online shop and which cannot be directly linked to your person, is not included. For example, these are statistics about which pages of our shop are particularly popular or how many users visit certain pages of the SPPW online presence.

2.3 customer account

For each customer who registers accordingly, we set up password-protected direct access to the inventory data stored with us (customer account). You undertake to treat the personal access data confidentially and not to make them available to any unauthorised third parties. We cannot accept liability for misused passwords unless we are responsible for the misuse.

2.4 Collection, processing and use of your personal data

We collect, store and process your data for the entire processing of your purchase, including any subsequent warranty claims, for our services, technical administration and our own marketing purposes.

2.5.2 Newsletter and individual advertising for you

The information we receive from you helps us to permanently improve your shopping experience and make it customer-friendly and individual for you. This information is used to create advertising tailored to you and your interests. For this purpose, we use existing information, such as confirmations of receipt and reading of e-mails, information about your computer and connection to the Internet, operating system and platform, your order history, your service history, date and time of your visit to the homepage and products you have viewed.

We use this information exclusively in pseudonymised form. By analyzing and evaluating this information, we are able to improve our website and our Internet offer and thus send you individual advertising, i.e. advertising that recommends products that might actually interest you. 2.5.3 Raffles, market and opinion research

In the case of competitions, we use your data for the purpose of notification of winnings and advertising our offers. You may find detailed information in our conditions of participation for the respective competition.

We also use your data for market and opinion research. Of course, we use these exclusively anonymously for statistical purposes and only for SPPW. Your answers in surveys are not passed on to third parties or published. We do not store the answers from our surveys together with your e-mail address or other personal data.

3 Cookies

The acceptance of cookies is a prerequisite for visiting our website.

3.1 What are cookies?

Cookies and flash cookies are small files that are stored on your data carrier and store certain settings and data for exchange with our system via your browser. There are basically two different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period of time or permanently. Your name, your IP address or similar data that would allow the cookie to be assigned to you are not requested at any time. On the basis of cookie technology, we only receive anonymised information, for example about which pages of our shop have been visited, which products have been viewed, etc.

3.4 What is targeting?

On the SPPW website data is collected on the basis of the cookie technology to optimize our advertising and the whole online offer. These data are not used to identify you personally, but serve only for an anonymous evaluation of the use of the homepage. At no time your data will be merged with the personal data stored with us. This technology enables us to present you with advertising or special offers and services whose content is based on the information obtained in connection with the clickstream analysis (for example, advertising based on the fact that in recent days only sports shoes were viewed). Our aim is to make our online offer as attractive as possible for you and to present you with advertising that corresponds to your areas of interest.

4 log files

With each access to the pages of SPPW, usage data is transmitted by the respective internet browser and stored in log files, the so-called server log files. The data records stored thereby contain the following data: Date and time of the call, name of the called site, IP address, referrer URL (origin URL, from which you were forwarded to the SPPW website), the transferred data volume, product and version information of the used browser.

Subject to any legal obligations to keep records, the IP addresses of users will be deleted or anonymized after the end of use. In the case of anonymisation, the IP addresses are changed in such a way that the individual details of personal or factual circumstances can no longer be attributed to a specific or identifiable natural person or can only be attributed to a specific or identifiable natural person with a disproportionate expenditure of time, cost and labour.

We evaluate these log file data records in anonymized form to improve our offer and the SPPW online shop further and to make it more user-friendly, to find and fix errors faster and to control server capacities. We use the function "Activation of IP anonymization" on this website. 8 Automatic logout / time monitoring

9 Chat
